Great! The only other funding source that can be used for plant establishment is the federal funds. We will discuss internally to see if we can avoid using Art 3 funds for plant establishment.

According to CTC guidelines, the County has 36 months from award to complete the project and can get one 12 month extension from that. It looks like the County will need money through
2027 for plant establishment and will not be able to use ATP for the period from 2026 to 2027. Is there another funding source you could use for that last year? If the SBCTA Board was
to approve an extension out until 2027, would the remaining $306,639 be sufficient?
Yes, the County can use the TDA Article 3 funds to hire an environmental consultant. However, if the County wishes to use these funds past 2024, they will have to provide a letter requesting
another extension to the SBCTA Board.

We need to hire SBKR trapping consultant and construction bio monitoring consultant before construction starts. These 2 contracts will end at the construction completion. The 5 year
plant establishment does include monitoring as well and we may need to hire another consultant. But if there is an issue for Art 3 funds to last such a long period, we can use federal
ATP funds. That work will not start until the construction is complete so we have time to follow federal process. But again if possible using Art 3 funds will still be a better option.
Actually I just called you and left a message about possibility of allowing the Art 3 funds be spent on any activities within the project scope. As you know we have a total of $1.4M
to cover the estimated environmental costs. It is possible that actual costs come in lower than estimated. Without restriction the leftover Art 3 funds can be used for construction
or CE.

Below is the estimated environmental mitigation cost. The federal ATP grant of $1.1M + the $300K Art 3 funds will cover the total $1.4M needed. As you can see, it will be great if we
can use ATP grant to pay the in lieu fee and Art 3 funds to hire consultants.
CTC fund allocation of the $1.1M ATP grant is on the upcoming CTC meeting agenda for Oct 18, 2021. We are finalizing the RFP for CON to obligate the funds after that. That is why we
need to know if we can use Art 3 funds to hire consultant now in order to structure the Finance Letter (Exhibit 3-A) correctly.
Once E-76 for CON is approved, County will pay the in lieu fee and start construction in the next few months.

This is not scope change, just a different cost item for the same scope.
The money was originally allocated to the project for any costs related to the project scope. At the time of time extension request we were planning to use it to cover in lieu fee. That
is how this specific language was used in both time extension request and SBCTA approval letter. There were no such restriction in original award.
In lieu fee is only a part of the environmental mitigation. Other environmental mitigation activities includes construction of habitat restoration area, environmental monitoring (consultant
costs), 5 year plant establishment including maintenance, irrigation, monitoring and reporting (consultants), etc.
The combination of this Art 3and federal ATP funds will cover all these costs. If Art 3 funds have to be used for in lieu fee, we will have to use federal ATP funds to hire consultants,
which is a lengthy process.

The ~$306K TDA Article 3 funds were approved to pay for In-lieu Program Mitigation of Permanent Impacts. This was a change from the previous scope of work. Please see first file attached.
But this amount is not enough to pay for the total cost of lieu fee. County applied and received ATP grant to cover the remaining environmental mitigation related costs.
Now that the ATP funds (federal funds) are more than enough to pay for the in lieu fee, is it possible for us to use the Art 3 funds to hire environmental consultant instead? This will
make it much easier and faster to bring the consultant on board.
