Great question. A project extension will apply to both the spending deadline and the contract award requirement. If the extension is for 1 year, we will expect the contract to be awarded by
the following annual update. These requirements help SBCTA staff verify that the project is moving forward as expected. Under TDA Article 3 guidelines, a contract must be awarded within 3
years because project awards span 4 years. If a contract is not awarded within that 3‑year window, it signals to SBCTA staff that the project may require an extension.

I believe that last year we were also confused about what the “Estimate of Expenses to Date” was referring to. We indicated $50 as we thought it was the total project cost to date and not just TDA
estimate. So far we have expended $50 to date. With the TDA local match, we have expended $37.50 of TDA funds so far. I believe it was a misunderstanding.
Our project manager is currently reviewing options to move the project toward award, and at this time we feel confident that we will be able to complete the contract award before the deadline. However,
if delays do arise, could you please confirm the deadline by which the City would be able to request an extension? Having that information will help us ensure we remain in full compliance with the grant
guidelines.

Thank you again for providing the updated expenses. I wanted to follow up regarding the “Rectangular Rapid Flashing Beacons” project. From what I can see, the reported TDA Article 3
expenditure to date for this project is lower this year than what was listed last year (last year’s report indicated approximately $50). Could you help to verify if this cost-to-date is accurate?
Additionally, as per TDA Article 3 grant guidelines, construction contracts need to be awarded within three years of the award notification. Since this project has been on our books for two
years now, could you confirm when the contract is expected to be awarded? Knowing this timeline will help ensure the City will be able to meet the grant requirements.

On May 3, 2023, the SBCTA Board approved changes to the program that now require annual Progress Reports. We hope this will help us get ahead of any potential issues and limit the
number of times we need to go to the Board with scope change and extension requests. In addition to the progress reporting requirement, awardees must also demonstrate expenditure of
some funds within ONE year of award notification and, for construction contracts, a contract must be awarded within THREE years of award notification. We expect there to be some leniency
for existing awards, particularly with the one year expenditure rule. If funds have not yet been spent, please provide a brief project schedule showing how the City intends to complete the
project by the deadline.
