Hi Carlos,
Thanks for the call. Just to recap, similar to what we had to do for Highland/Redlands Connector, please send a letter requesting a scope change for TDA
Article 3 (1) CON funds to be moved to Pre-CON and (2) from project construction to project design/environmental. Be sure to note why the ATP funds are
having to be forfeited in your letter including:
Required 2-3 year Army Corp of Engineers approval process (with no guarantee that it will be approved after that duration).
County Flood Control’s 10+ year delay in repairing the project section as required by the Corp.
County’s refusal to commit (1) to a schedule for when they will, if ever, make the repair and (2) to replace any improvements made through the ATP
project should that repair come after project completion.
Issues with the existing bridge that the original project scope thought could be used but which in fact cannot unless additional funds are secured.
As indicated before, you are welcome to submit a 9th invoice that does not exceed the 20% retention. The remainder will be subject to Board approval.

The problem is that we can’t just move the funds around without authorization. Unless the CTC approved a revised PPR that shows TDA Article 3 being all
Pre-Con (please share a copy if that is the case!), then we’ll need the City to request a scope change that moves the $29k TDA Article 3 CON to pre-CON
and we will have to take this request to the SBCTA Board for their approval. Additionally:
I’ll review, and process if it meets all the requirements, invoice #8.
Because there is a 20% retention until project completion, invoice #9 can be for a total of no more than $31,708.30. This leaves a balance of
$74,309.25 (or 20%) which is more than the $29k that the City wants to move to Pre-Con. So approval of the scope change shouldn’t be what holds
anything up.
Please use the updated Claim Form attached for invoice #9; it assumes all is well with invoice #8 and starts from there.

Sorry I’m only just now getting back to reviewing this and it’s a lot to process. Thankfully we are allowed to defer to whatever the CTC approves however, there are
a couple of things that aren’t lining up well with the summary provide on #4 below.
According to Invoice #8, the total spent should be $410,341 but you’re showing $516,120.47 below. What am I missing here?
While the CTC seems to have approved a scope change from pre-con & con with a project total of $3,965,000 to just con for $2,354,000, I’m not seeing
where they authorized a project total change to $4,084,020.47. Was that approved by any agency other than the City? Was a revised PPR provided to the CTC
that showed TDA Article 3 no longer contributing to CON? At least the total TDA Article 3 amount decreased so we might be able to avoid taking this to
Board, but if you have proof of approval by the CTC, or some other form of documentation, that would be helpful.

I did some more digging around on the City Creek/Alabama Street Bikeway project and have new questions on that one:
1. Is everything still on track to allocate construction funds by 2/28/23? It looks like the CTC approved an allocation extension (link) for this project which
automatically extends the TDA Article 3 completion deadline to 2/28/2026.
Response: The requirement is to submit the construction allocation by 2/28/2023 which we did. The construction allocation funds were approved at the
CTC March 23rd meeting, see attached email from Eduardo with Caltrans Local Assistance received today.
2. Can you please provide a copy showing approval of the phase budget/scope change? According to the CTC extension approved in 12/2020, the ATP ROW
budget is now $817 and, according to the extension awarded in 6/2021, the ATP CON budget is $2,354. Below shows the budget according to the City’s ATP
application which appears to have been modified.
Response: The email from Eduardo includes a copy of the Finance Letter and it reflects CON State ATP Funds of $2,354,000. We did not allocate ATP ROW
funds for this project.
3. Is the City of San Bernardino still going to contribute to this project as planned?
Response: The City of San Bernardino has a very small share of the project cost, and they will still contribute their share of the cost.
4. Can you please correct and complete the summary below?
